Man faces burglary charges; hotel tips police

ROCHESTER — A Maine man is being held on $10,000 cash bail after pleading innocent Monday to several charges connected to two burglaries in the city.

Justin Fuller, 25, of 11 Whipple Road in Kittery, Maine, was charged with burglary, attempted burglary, theft, criminal trespassing, loitering or prowling, possessing burglary tools and receiving stolen property.

On Wednesday, Fuller allegedly stole a safe from a home on Dry Hill Road. The following day, a hotel clerk at the Holiday Inn Express in Rochester reported that the hotel found several items from the home — including a Spaulding High School diploma, paperwork, a red jewelry box, pocket watches and a pen knife — in Fuller's room. Additionally, the clerk overheard Fuller allegedly say he'd need “an axe to open the safe” during a phone conversation, according to court records.

A warrant for the charges of receiving stolen property, valued between $500 and $1,000, was issued for Fuller's arrest Friday.

On Saturday night, a couple on Walnut Street came home and called police after they found a locked door open, that a motion light was activated and a key to the garage was missing. They also thought they spotted someone running out of the home, according to court records.

Police responded at 11:12 p.m. and called for a K-9 team to help with the search. The police dog led officers to a man “in camouflage hiding behind a dumpster.” He had a headlamp flashlight, a maroon bike, which he allegedly used to escape the home, and a grey backpack, according to court records.

Upon searching the backpack, police discovered a hammer, a hatchet, some de-scenter, a machete, a toy pellet gun, a pry bar, a screwdriver, a pair of binoclulars, bugspray and a coffee container filled with change, according to court records.

“These tools are also consistent with tools used for burglary,” according to the affidavit.

Officers later found the missing garage key with Fuller, according to court records.

During his arraignment in Rochester District Court, Fuller pled not guilty to five misdemeanor charges and entered no plea to the two felony charges of burglary and attempted burglary.

Fuller, who was held on in Strafford County Jail in Dover since his arrest, will remain held on bail with the conditions he have no contact with the homeowners and not enter the two homes on Dry Hill Road and on Walnut Street. If released, he must also report to a probation officer and sign a waiver of extradition, according to court records.

Fuller is scheduled to appear for a probable cause hearing Aug. 30 at 1 p.m. and at a trial for the misdemeanor charges Nov. 1 at 1 p.m. in Rochester.

Theft, criminal trespassing, loitering or prowling, possessing burglary tools and receiving stolen property are all Class A misdemeanors, which are each punishable by a year in jail, if convicted.
